				<content:encoded><![CDATA[<p>Another dictator has been lost in South America.  This regime change did not come from a latin spring but from disease.  Cancer does not respect a person and rarely do we witness such a public fight by a world leader.  In all definitions of the word, Chavez was a socialist dictator with the charisma to match.</p>
<p>What is relevant to Americans about his passing? It highlights our form of government.  While it is not working the way it is intended by our framers, our system is stable. Safeguards built into our system restrict the demagoguery of personality to limited areas which is frustrating sometimes. It would be easier to allow a cult personality to solve the systematic  inefficiencies of a republic with a benevolent dictator or empowered CEO.  President Obama struggles with the inefficiency of a republic with attempts to thwart the system.  I don&#8217;t blame him but Chavez&#8217;s death illuminates why our system refuses such attempts: predictability.  If our President passed away or was unable to govern due to his humanity, our system has solved that problem before it even presents itself.  Getting around the 535 people in Congress would eliminate you and me.  Our inefficiency proves the point that disease, death and regime change are predictable so the purest form of government, a system of scenarios with predictable outcomes, is one that sacrifices the principle for the power.</p>

				<content:encoded><![CDATA[<p>Regulations issued by the Consumer Financial Protection Agency will rock the real estate foreclosure market.  Two specific regulations should be noted by real estate market watchers.  First, the CFPB has issued a prohibition against “dual tracking,” which is the process of starting foreclosure procedures while the borrower has requested help from the lender.  I think this is a good rule because many borrowers are caught at the last minute waiting like a pressure cooker for a modification response and a pending foreclosure date.  This “gotcha” tactic by the lenders should be barred.</p>
<p>Second and most important, lenders are barred from starting foreclosures until the borrower has missed four payments.  The thoughts behind this regulation is that four months allows the borrower to request short sale help or modifications.  Practically a borrower could miss three payments then apply for help to keep the home and that application would delay the foreclosure process further.</p>
<p>The bottom line is that lenders are going to have to start getting very creative with borrowers to work out foreclosure solutions.  Borrowers need to seek legal help as soon as possible so that the time frames can be maximized to transition to a new financial position.</p>

<p>Leading attorneys in the U.S. are asking as much as $1,250 an hour, significantly more than in previous years, taking advantage of big clients&#8217; willingness to pay top dollar for certain types of services.</p>
<p>A few pioneers had raised their fees to more than $1,000 an hour about five years ago, at the peak of the economic boom. But after the recession hit, many of the rest of the industry&#8217;s elite were hesitant, until recently, to charge more than $990 an hour.</p>
